Terms of sale

  1. Transferring an order implies that the buyer agrees to these terms and conditions of sale.
  2. All offers are non-binding and while stocks last.
  3. Prices are for trade only and the offer is in P9.
  4. Prices apply from 24 units per variety, excluding VAT and ex nursery. When purchasing smaller quantities, the surcharge below applies. Prices for larger quantities are available on request:
    -1 piece surcharge € 0.35 per plant
    -2-5 pieces surcharge € 0.25 per plant
    -6-11 pieces surcharge € 0.15 per plant
    -12-23 pieces surcharge € 0.05 per plant
  5.  All prices in this catalogue are only guide prices (i.e. recommended prices) established on the basis of the (fictitious) market situation at the time the catalogue was written. The producer is in no way bound by said prices and can always deviate from the recommended prices according to market conditions.
  6. Packaging is changed immediately on loading or charged t.w:
    -VML: €3.25
    -VMH: €4.00
    -Pallet: €10.00
    -Europallet: € 13.00
    For carriage-paid returns, only whole and clean crates will be taken minus €0.11. Crates taken in season must be returned before 1 August. If not, they will be invoiced. If more crates are returned than were delivered, €0.55 will be deducted for low crates and €0.65 for high crates. If crates are returned by the seller, the seller retains the right to credit € 0.22.
  7. Shipping is at the buyer's risk.
  8.  Objections concerning plants will only be accepted within 8 days after delivery, about packaging this is 30 days after delivery.
  9. We cannot guarantee regrowth given the impossibility of monitoring the treatments. Authenticity is guaranteed. In the event of an error, the buyer can never receive compensation higher than the invoice value of the plants in question.
  10.  Unless otherwise stipulated by the buyer, the seller has the right to replace the missing species with the best similar ones without prior notice.
  11.  The seller shall be released from his commitments to deliver plants in the event of harvest failure, abnormal weather conditions or other cases of heir force. He will notify the buyer in writing.
  12. All goods remain the property of the seller until paid in full.
  13. The seller has the right not to execute orders if previous invoices are not paid within the stipulated period.
  14.  If the collection of the purchased goods has not taken place at the agreed time, the seller may cancel the contract. In this case, compensation will be payable by the buyer to the value of the order placed plus a penalty of 20% of the selling price under Articles 1226 et seq. of the Civil Code.
  15.  All invoices are payable within fourteen days from invoice date unless otherwise agreed in writing.
  16. In case of non-payment within the above-mentioned term, an interest of 1% per month of delay will be paid on the amount due without any reminder being required. In addition, the amount of the invoice shall be increased ipso jure and without notice of default by a sum of 15% of the invoice amount with a minimum of € 40.00 by way of damages and additional costs, this apart from possible legal costs and interest.
  17. Foreign cheques are not accepted.
  18. In case of dispute, only Belgian law shall apply and only the Courts of the district of Turnhout shall have jurisdiction.
